Legislation and Regulation - MOBI.E
The Legal Framework for Electric Mobility (RJME) is the instrument that regulates the organization, access, and operation of electric mobility activities and proceeds to establish a pilot electric mobility network as well as regulates incentives for the use of electric vehicles.
The RJME was initially published through Decree-Law no. 39/2010 and was later amended by various statutes. You can consult its current version here.

The current Electric Mobility Regulation (RME) was approved by Regulation no. 854/2019 of the Energy Services Regulatory Authority, published on November 4, and later amended by Regulation no. 103/2021 of February 1. The consolidated version can be consulted here.
The European Regulation on Alternative Fuels Infrastructure (AFIR, English acronym) aims to support the transition to more sustainable transport by setting mandatory targets for the deployment of charging and refueling infrastructure.
Uniform application of the AFIR across the European Union aims to facilitate zero-emission road transport of passengers and goods, remove trade barriers, and create economies of scale for manufacturers and operators of alternative fuels infrastructure.
AFIR revokes and replaces the previous European Directive on Alternative Fuels Infrastructure (AFID), Directive 2014/94/EU, which had been transposed by Decree-Law no. 60/2017, of June 9.

The main AFIR targets for light electric vehicles are as follows:
NETWORK POWER (Article 3, no. 1)
Provision of 1.3 kW per BEV and 0.8 kW per PHEV in the public charging network at the end of each year;
TERRITORIAL COVERAGE (Article 3, no. 4)

Until 31/12/2025 - Guarantee of 400 kW and 1 point of 150 kW every 60 km
Until 31/12/2027 - Guarantee of 600 kW and 2 points of 150 kW every 60 km - On the Comprehensive Trans-European Transport Network (TEN-T):
Until 31/12/2027 – Guarantee of 300 kW and 1 point of 150 kW every 60 km (on 50% of the network)
Until 31/12/2030 – Guarantee of 300 kW and 1 point of 150 kW every 60 km
Until 31/12/2035 – Guarantee of 600 kW and 2 points of 150 kW every 60 km
Directives from the Energy Services Regulatory Authority (ERSE)
- Directive no. 8/2020 - General conditions of the accession contract to the electric mobility network and the methodology for calculating guarantees to be provided to the Electric Mobility Network Management Entity, supplementing the RME.
- Directive no. 13/2024 - Revenues and tariffs of the EGME, applicable to Electric Mobility Electricity Suppliers (CEME), Charging Point Operators (CPO), and Charging Point Owners (DPC) with private access, for the period from January 1, 2025, to December 31, 2025.

- Installation of Publicly Accessible Charging Stations - Establishes procedures and exemplary schemes for the concession, inspection, survey, and certification of installations of public accessible electric vehicle charging stations.
- Technical guide for electrical installations for electric vehicle supply - Technical guide for electrical installations for electric vehicle supply - Informative and guiding working document, intended to provide indications for the concession, project and implementation of electrical installations for electric vehicle supply.
- ORDER No. 22/2024 - Establishes the procedures and exemplary schemes for the concession, inspection, survey and certification of Electric Vehicle Charging Station (ECVE) installations, located in an area or open to the general public, regardless whether the ECVE is located on public or private property, regardless of whether or not there are limitations or conditions applicable to access the location or installations and regardless of the applicable conditions of use.
- ORDER No. 19_DG/2021 - Authorizes electrical installation inspection entities recognized by DGEG with experience in private service electrical installations type C to inspect EVCS installations powered by private low-voltage networks belonging to type B consumption facilities.
- ORDER No. 24/2019 - Establishes procedures for certification/inspection of electric vehicle charging points (EVCP) connected to the electric mobility network. It also sets forth models resulting from EVCP survey and inspection acts.
- ORDER No. 26/2017 - Establishes the components of the simplified project. The simplified project aims to represent the electrical installation for verifying compliance with safety regulations by licensing, supervisory, inspection entities or responsible technicians. - DECREE-LAW No. 60/2017 - Establishes the framework for the deployment of alternative fuel infrastructure, in order to reduce oil dependence and mitigate environmental transport impact.
- ORDINANCE No. 231/2016 - Establishes coverage, conditions, and minimum capital for mandatory civil liability insurance in the activities of electricity marketing and operation of electric mobility charging points.
- ORDINANCE No. 222/2016 - Establishes the applicable terms for the licenses for the private use of public domain areas, for the installation of electric vehicle battery charging points in public locations with public access within the public domain, particularly when such areas are part of the water domain.
- ORDINANCE No. 221/2016 - Establishes the rules for installation and operation of battery charging points for electric vehicles, including mandatory compliance with technical and functional requirements for smart meters.
- ORDINANCE No. 220/2016 - Establishes the minimum power requirements and the technical rules that must be met by electric vehicle charging installations in buildings and other urban developments that include applicable parking areas.
- ORDINANCE No. 252/2015 - Establishes technical standards for installation and operation of normal charging points in buildings and other urban operations.
- ORDINANCE No. 241/2015 - Establishes the technical requirements for granting a license to operate electric mobility network charging points, as well as certain procedural rules applicable to the submission of the corresponding application.
- ORDINANCE No. 240/2015 - It sets the amount of fees due for the assessment of the application, and implementation, of the registration of electricity marketing for electric mobility, for the issuance of the operating license, for charging points and for carrying out periodic inspections.
- RCM No. 49/2016 - Assigns MOBI.E, S.A. authority for operational and relocation decisions on all charging stations under the pilot network status. Determines completion of the 1st Mobi.E Pilot Network phase and launches the 2nd expansion phase to all municipalities.
- ORDER No. 8809/2015 - Integrates the Electric Mobility Action Plan, the locations of fast and normal charging stations of the MOBI.E pilot network, yet to be installed and temporary transfer of ownership of pilot network charging points to the electric mobility network manager.
